“I’m a trustee… but I’m not really sure what I should be doing?”
If that’s how you’re feeling, you’re not alone — especially if you’re stepping into the role for the first time.
The law is detailed. Trust documents aren’t exactly known for being easy reading. And it’s common to end up in one of two places: stuck overthinking every decision, or just signing things off and hoping for the best (while quietly wondering what you’ve just agreed to).
Neither feels particularly comfortable.
And while it’s true that trustees have legal duties, starting with the technical details can be like trying to decorate a cake before you’ve even baked it. There’s nothing solid for the detail to stick to — and it quickly becomes messy and overwhelming.
Before diving into the legal side, it helps to step back and look at the big picture — then start building your foundation for the role.
At its core, being a trustee is actually quite straightforward: You’re looking after assets for the benefit of other people. That's your big picture.
From there, you can begin building the base with a few practical questions:
- What are the assets you’re responsible for?
- Who are you looking after the assets for — and what might those people need, now and in the future?
- Why was the trust set up in the first place?
The answers to these questions give you the foundation for your particular trust, and context for every decision you make as a trustee.
Once those layers are in place, the detail isn't so overwhelming. The legal duties, the trust deed, and the compliance requirements start to make sense, and feel more like a helpful recipe than a jumble of legalese.
Being a good trustee doesn't require knowing the law inside out. It’s about understanding the big picture, getting the fundamentals right, and knowing when to ask for help. When you do need advice, it tends to make much more sense— because you’ve already got a base to work from.
